CONDITIONS OF PARTICIPATION FOR COMPETITIONS
Participation in all competitions organised by Bike24 GmbH or its legally affiliated companies within the meaning of §§ 15 ff. AktG (hereinafter jointly referred to as "Bike24") shall be governed by the following general terms and conditions of participation (hereinafter referred to as "Conditions of Participation") as well as the supplementary Special Conditions of Participation, which are specified in the individual competitions in the respective social media post for the competition (hereinafter referred to as "Special Terms and Conditions"). In the event of a conflict between the Special Terms and Conditions and Conditions of Participation, the Special Terms and Conditions shall take precedence over these Conditions of Participation. By participating in the competition, each participant accepts these terms and conditions of participation as well as the special terms and conditions of the competition.
1.1 ORGANISER OF THE COMPETITION
The competition is organised by Bike24 GmbH, Breitscheidstr. 40, 01237 Dresden, Germany (hereinafter referred to as the "Organiser") on the Organiser's social media channels (Facebook, Instagram, YouTube, STRAVA).
1.2 PERSONS AUTHORISED TO PARTICIPATE AND EXCLUSION FROM THE COMPETITION
All natural persons who have reached the age of 18 at the time of participation are eligible to participate. In this respect, the Organiser reserves the right to check the age of the competition participants. Each participant may only participate in their own name. If a participant is limited in their legal capacity, the consent of their legal representative is required. Employees of Bike24, their relatives and household members as well as persons involved in the development and realisation of the competition are not eligible to participate. In addition, persons who make use of unauthorised aids or otherwise gain advantages through manipulation will be excluded from participation in the competition. In order to participate in the competition, all information provided by participants must be true and must not violate applicable law. Otherwise they will also be excluded from the competition. In addition, the organiser reserves the right to exclude persons from the competition in the event of a breach of these conditions of participation. In the aforementioned cases leading to exclusion, the prize may also be subsequently cancelled and reclaimed without compensation. In the event of cancellation, no new winner will be determined.
1.3 PARTICIPATION IN THE COMPETITION
Participation in the competition is free of charge. There is no entitlement to reimbursement of costs. The specific requirements for participation in the competition and the participation period for the competition will be specified by the organiser in the special terms and conditions for the competition. As a rule, participants will be asked to comment on and/or like a post made by the organiser on their social media channels, to link other people and/or to post their own content/images. In order to successfully participate in the competition, both these conditions of participation and the sepcials terms and conditions must be fulfilled in full.
1.4 DETERMINING THE WINNERS
After the end of the participation period, one or more winners will be selected from all participants by means of a random draw in accordance with the special terms and conditions of the competition and will be contacted promptly via the Organiser's social media channels. The winners are obliged to inform the Organiser within two (2) weeks of receipt of the notification in the form described therein whether they accept the prize. In the event of non-compliance with this deadline, the winners' claim to the prize shall lapse without substitution; in particular, there shall be no enforceable claim to payment or surrender of the prize. In this case, the Organiser is entitled, but not obliged, to determine new winners by means of a new random draw and to award the prize elsewhere.
1.5 PRIZES
The winners will receive the prize specified in the special terms and conditions. The prize will only be paid out or handed over to the winner or their legal representative. The prize cannot be paid out in cash. Legal recourse is excluded.
1.6 LIABILITY
The Organiser shall be released from any existing obligations when the prize is handed over, unless an earlier date is specified in these Conditions of Participation or the special terms and conditions. The Organiser is not liable for material defects and/or defects of title in the prize. The Organiser shall only be liable for gross negligence or intentional acts by its legal representatives, employees or vicarious agents. The Organiser shall not be liable for damages suffered by the winners or their relatives in connection with the prize. The organiser's liability is otherwise excluded to the extent permitted by law. The above exclusion of liability shall not apply in cases of mandatory liability, in particular in cases of wilful intent and gross negligence due to injury to life, limb or health or due to the breach of material contractual obligations. However, the claim for damages for the negligent breach of essential contractual obligations is limited to the foreseeable damage typical for the contract. The above provisions do not imply a change in the burden of proof to the detriment of the participants.
1.7 DATA PROTECTION
By participating in the competition, the participants, in particular the winners, agree to the processing of their personal data (profile name, first name, surname, address if applicable, date of birth if applicable, e-mail if applicable). The data will be processed by the organiser exclusively for the purpose of running the competition. Participants are informed that their consent under data protection law can be revoked at any time with effect for the future. Participants can find further information on the processing of personal data and their rights as data subjects in the Organiser's privacy policy.
1.8 OTHER GENERAL PROVISIONS
The law of the Federal Republic of Germany shall apply exclusively. Should any of these terms and conditions be or become invalid, this shall not affect the validity of the remaining terms and conditions of participation. These Conditions of Participation may be amended by the Organiser at any time without prior notice and without giving reasons. In accordance with Directive 2013/11/EU, the EU Commission is setting up an internet platform for the online settlement of disputes ("ODR platform") between companies and consumers. This can be accessed via the following link: http://ec.europa.eu/consumers/odr . However, the organiser points out that it is not obliged and not willing to participate in an arbitration procedure.
